Engineering and technical support of regulatory requirements of Department of Homeland Security (DHS), Department of Transportation (DOT), Occupational Safety & Health Administration (OSHA), Environmental Protection Agency (EPA) and Transportation Security Administration (TSA) applicable to hazmat transportation and storage.
The safe storage and handling of hazardous materials are subject to OSHA regulations relative to employee safety, EPA regulations for community safety, state and local fire regulations and ordinances referencing National Fire Protection Association (NFPA) or Uniform Fire Code (UFC) and most recently the International Fire Code (IFC). Transportation of hazardous material (hazmat) is under the jurisdiction of the US Department of Transportation (DOT).
Permitting & Construction
Our staff has lead the permitting effort for obtaining ND Public Service Commission permit for pipeline construction for at least 1 project each year in recent history in addition to other projects which don't require PSC permits. Other permitting agencies include the US Corps of Engineers, County Commissions, ND Dept of Transportation, US Forest Service as well as the ND Dept of Health.
Our team of engineers can design a pipeline system in compliance with ND State and US DOT rules and provide construction oversight, including environmental inspection services. Our life science staff can develop and implement tree and wetland mitigation plans for the project as well.
Locating Utilities
Using traditional and non-traditional methods, utility lines are located and mapped in ESRI ArcGIS. Our staff has experience with ground pentrating radar and electrical conductivity equipment to locate even polyethylene pipe without trace wires.
Transportation Security Plans
Current regulations require owners / operators to develop a plan and train applicable employees on its content.
The regulation applies to shippers or transporters of the following hazmats:
A highway route-controlled quantity of a Class 7 (radioactive) material;
More than 25 kg (55 lbs) of a Division 1.1, 1.2, or 1.3 (explosive) material;
More than 1 L (1.06 qt) per package of poisonous by inhalation material in Hazard Zone A;
A bulk shipment package with a capacity equal to or greater than 13,248 L (3,500 gal) for liquids or gases or greater than 13.24 cubic meters (468 cubic feet) for solids;
Infectious substances listed as select agents by the Centers for Disease Control and Prevention (CDC) in 42 CFR part 73; and
A shipment that requires placarding.
Security plans must include:
An assessment of possible security risks for hazmat shipments;
Appropriate measures to address these security risks;
Personnel security, including measures taken to confirm background information provided by employees hired for positions that have access to hazardous materials covered by the security plan;
Unauthorized access procedures, including measures to address the risk that unauthorized persons could gain access to facilities or vehicles used to transport hazardous materials covered by this rule; and
En Route security, including assessment by the shipper and carrier of security risks associated with hazmat transportation from origin to final destination, including temporary storage incident to transportation.
The security plan must be in writing and retained as long as it remains in effect. Copies of the plan, or portions thereof, must be available to employees responsible for implementing the plan, in a manner consistent with security clearances and a demonstrated need to know.
